The terms that apply when you use Lendology's mortgage broking services.

These terms and conditions govern the provision of credit assistance and mortgage broking services by Given Finance Pty Ltd (trading as Lendology, ACN 624 144 501). By engaging our services, you agree to these terms.

About these terms

Given Finance Pty Ltd (t/a Lendology) is an Authorised Credit Representative (Credit Representative Number 511784) of LMG Broker Services Pty Ltd (ACN 632 405 504), which holds Australian Credit Licence 517192. These terms apply to all credit assistance services we provide to you.

We may update these terms from time to time. The current version will always be available on this page. Continued use of our services after any update constitutes acceptance of the revised terms.

Credit assistance services

Lendology provides credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth). Our services include:

  • Assessing your financial position and borrowing capacity
  • Researching and comparing loan products across our panel of 60+ lenders
  • Recommending loan products that are not unsuitable for your requirements and objectives
  • Preparing and submitting loan applications on your behalf
  • Managing the application process through to settlement
  • Providing ongoing post-settlement support including annual loan reviews

Your obligations

When engaging our services, you agree to:

  • Provide accurate, complete and current information about your financial position, including income, expenses, assets, liabilities and employment details
  • Promptly notify us of any material changes to your financial circumstances during the application process
  • Provide identification documents and supporting documentation as reasonably requested
  • Review all loan documentation carefully before signing
  • Respond to our communications in a timely manner to avoid delays in your application

You acknowledge that providing false or misleading information may result in your loan application being declined, your loan being recalled by the lender, or potential legal consequences.

Our obligations

Best Interests Duty: Under the National Consumer Credit Protection Act 2009, we are required to act in your best interests when providing credit assistance. This means we must prioritise your interests ahead of our own when recommending loan products.

Responsible lending: We are required to make reasonable inquiries about your financial situation, verify the information you provide, and make a preliminary assessment that any loan we recommend is not unsuitable for you. A loan will be considered unsuitable if it does not meet your requirements and objectives, or if you would be unable to meet the repayment obligations without substantial hardship.

Credit guide: Before providing credit assistance, we will give you a Credit Guide that explains how we operate, how we are paid, and how to make a complaint. You are entitled to request a copy of our preliminary assessment at any time.

Fees and charges

Lendology's mortgage broking service is provided at no cost to you, the borrower. We are remunerated by the lender through:

  • Upfront commission - paid by the lender when your loan settles, typically calculated as a percentage of the loan amount
  • Trail commission - an ongoing payment from the lender for the life of the loan, calculated on the outstanding loan balance

The specific commission rates vary between lenders and products. We will disclose the estimated commissions to you in writing before you proceed with a loan application. Commission arrangements do not influence our recommendations - we are bound by the Best Interests Duty to recommend the most suitable product for you regardless of the commission payable.

While our service is free, you may incur costs from third parties involved in your loan, including lender application fees, valuation fees, legal and conveyancing fees, government charges such as stamp duty, and Lenders Mortgage Insurance if applicable. We will outline all anticipated costs before you commit to a loan.

Privacy and data handling

We collect, use and disclose personal information in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles. By engaging our services, you consent to us collecting and using your personal information for the purpose of assessing your loan application and providing credit assistance.

We may share your information with lenders, our aggregator (Loan Market Group), credit reporting bodies, valuers and other parties as necessary to process your application. We do not sell your personal information to third parties.

Intellectual property

All content on the Lendology website, including text, graphics, logos, images, calculators, and software, is the property of Given Finance Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

Complaints and disputes

We are committed to resolving any complaints promptly and fairly. If you have a complaint about our services:

  1. Contact us directly: Raise your concern with us by phone on 08 8270 5138 or by email at jason@lendology.com.au. We will acknowledge your complaint within 24 hours and work to resolve it as quickly as possible.
  2. Internal dispute resolution: If your complaint is not resolved to your satisfaction through initial contact, we will escalate it through our internal dispute resolution process and provide you with a written response within 30 days.
  3. Australian Financial Complaints Authority (AFCA): If you are not satisfied with our response, you may lodge a complaint with AFCA, our external dispute resolution scheme. AFCA provides a free and independent service.

Limitation of liability

To the maximum extent permitted by law, Lendology and its directors, employees and agents will not be liable for any loss or damage arising from:

  • A lender's decision to decline or approve your loan application
  • Changes to interest rates, fees or loan terms made by a lender after settlement
  • Delays caused by third parties, including lenders, valuers, solicitors or government bodies
  • Your reliance on general information provided on our website or in marketing materials
  • Any loss arising from inaccurate or incomplete information provided by you

Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law or other legislation that cannot be lawfully excluded.
